《曲靖市地方煤矿安全监督管理若干规定》已经2005年7月28日曲靖市人民政府第40次常务会议通过,现予公布,自2005年8月10日起施行。

曲靖市地方煤矿安全监督管理若干规定
第一条 为认真贯彻落实党和国家的安全生产方针、政策、法律法规、规章标准,切实加强煤矿安全生产监督管理,有效防范煤矿安全事故,保障人民生命财产安全。依据《煤炭法》、《安全生产法》、《矿山安全法》、《乡镇煤矿管理条例》、《安全生产违法行为行政处罚办法》、《煤矿安全规程》等有关法律法规,结合曲靖市地方煤矿安全生产实际,特制定本规定。
第二条 本规定所称的煤矿安全生产监督管理是指上级人民政府及其煤矿安全监督管理部门对下级人民政府及其煤矿安全监督管理部门贯彻落实党和国家的安全生产方针、政策、法律法规、规章的依法监督检查,煤炭安全生产监督管理部门对本行政区域内依法纳入管理的煤炭生产企业(简称煤矿企业)的依法监督检查。
曲靖市煤矿安全监督管理局为全市煤矿安全监管机构,各产煤县(市)区也必须明确相应的煤矿安全监督管理部门。
第三条 依法纳入管理的煤矿企业是指取得采矿许可证、煤炭生产许可证、安全生产许可证、矿长资格证、矿长安全工作资格证、工商营业执照以及符合安全设施“三同时”的煤矿在建矿井。
第四条 各产煤县(市)区政府及其煤矿安全监督管理部门必须认真宣传贯彻有关煤矿安全的法律、法规,对辖区内煤矿企业贯彻执行有关煤矿安全法律、法规、规程的情况依法进行监督检查,对违法违规行为予以纠正或制止,并按相关规定实施相应的行政处罚;必须切实履行煤矿安全监督管理职责,未按规定履行职责,造成煤矿安全事故发生,构成渎职犯罪的,依法追究刑事责任。
第五条 各产煤县(市)区政府必须制定煤矿重特大安全事故应急救援预案,经政府主要领导人签署后实施,并报市政府备案。
第六条 各产煤县(市)区政府及其煤矿安全监督管理部门必须建立以下安全监督管理制度。
(一)安全生产责任制度
建立市、县、乡镇、煤矿企业、职工五级安全生产责任体系,落实责任部门及责任人,签订责任书,并制定系统、严格的考核奖惩办法,实行重奖重惩,采取经济的、行政的、法律的手段,确保安全生产责任制落到实处。
(二)安全办公会议制度
产煤县(市)区政府每个季度至少召开一次煤矿安全办公会议,市煤矿安全监督管理部门每季度不少于一次煤矿安全办公会议,县煤矿安全监督管理部门每月不少于一次煤矿安全办公会议,煤管所(煤炭分局)每月不少于二次煤矿安全办公会议。安全办公会议必须认真分析总结前段煤矿安全生产工作的经验,找出存在的问题,安排部署下步工作,并提出督促、检查煤矿安全工作的具体措施和办法,会议要作出决定并形成会议纪要。
(三)安全检查、督查制度
市级煤矿安全监督管理部门每年组织不少于二次安全大检查,四次重点督查;县煤矿安全监督管理部门每季度组织不少于一次安全大检查,两次重点督查;煤管所(煤炭分局)每月组织不少于一次安全大检查、三次重点督察。
(四)安全隐患整改制度
对查出的煤矿安全隐患或存在的问题必须严格按照定责任人、定措施、定时间的“三定”原则进行整改落实,并向上级主管部门上报整改情况。限期内未整改的,予以停产整顿,并按有关规定实施行政处罚。对监督整改不力,导致发生安全事故的,对监管各部门有关责任人要给予必要的处分,触犯刑律的要依法追究刑事责任。
(五)领导分片挂钩联系制度
市县两级政府及煤矿安全监督管理部门必须建立领导分片挂钩联系煤矿安全生产制度,并制定挂钩联系的奖惩办法。
(六)领导下井检查制度
市煤矿安全监督管理部门主要领导每月下井不少于一次,县级党政主要领导每季度下井不少于一次,县级分管领导每月下井不少于1次,县煤矿安全监督管理部门主要领导每月下井不少于5次,分管领导每月下井不少于10次。
(七)安全生产总工程师负责制度
市县两级设立总工程师办公室,负责审批煤矿安全、生产技术方案或措施。建立健全工作岗位责任制,对因方案或措施审查不严,导致发生事故的,依法依规追究审批者的责任。
(八)安全宣传报道制度
要充分利用活动、标语、板报、广播、电视、新闻媒体等手段,加强煤矿安全宣传教育。各县(市)区每年必须组织不少于两次的大规模宣传教育活动,永久性固定标语每矿不少于五条。
(九)安全事故查处制度
要按照“四不放过”的原则,严肃查处煤矿事故,严肃追究事故直接责任者和负有领导管理责任的有关负责人的责任,严格执行《云南省煤矿安全事故伤亡赔偿暂行规定》,对在安全监督管理工作中未履行职责或职责履行不到位的,要依照《安全生产法》给予行政处分。
(十)重大危险源监管制度
对辖区内煤矿企业重大危险源实行定期或不定期的检查督查,制定防范治理措施,明确责任人及监管职责。
(十一)煤矿建设“三同时”监督检查制度
加强对在建(含新建、改扩建)项目安全设施“三同时”的监督检查,对未按建设项目“三同时”管理的煤矿企业,应及时予以纠正或限期整改。
(十二)安全培训教育制度
制定安全培训教育计划,对煤矿企业矿长、副矿长、特种作业员、安全技术管理人员、从业人员按相关标准进行培训教育并取得相应的从业资格。
(十三)安全投入监督检查制度
对煤矿企业安全专项资金的提取和使用的全过程进行监督检查,保证安全技术、管理、装备、设施投入到位。
(十四)安全评价、检验检测制度
对煤矿企业矿井安全评价、机电产品、安全仪器仪表检验检测定期监督检查。
(十五)行政处罚制度
各级煤矿安全监管部门要根据《行政处罚法》和《安全生产违法行为行政处罚办法》的有关规定,结合实际制定相应的行政处罚制度,确保行政处罚的合法、公平、公正。
(十六)安全监察和安全监管协调工作制度
各级煤矿安全监管部门与煤矿安全监察、安全生产监督管理部门要加强联系、密切配合、协调行动,建立工作通报、信息交流和联系会议制度,及时协商解决煤矿安全监察、监管工作中的重大问题,建立和完善联合执法机制,杜绝重复执法,努力提高工作效率。
第七条 各产煤县(市)区政府及其煤矿安全监督管理部门应当将煤矿企业瓦斯治理作为安全监管工作的重点,对下列重点矿井实施日常性安全监督检查:
1.煤与瓦斯突出矿井;
2.高瓦斯矿井;
3.有瓦斯动力现象的矿井;
4.有高瓦斯区域的低瓦斯矿井;
5.开采容易自燃和自燃煤层的矿井;
6.采用放顶煤开采法开采的矿井。
重点监督检查下列内容:
1.瓦斯治理责任制;
2.安全投入;
3.瓦斯治理机构设立和人员配备;
4.防治瓦斯的管理制度和安全技术措施;
5.瓦斯抽放系统;
6.通风系统;
7.安全监控系统及电气防爆性能;
8.“四位一体”综合防突措施;
9.综合防治煤层自燃的措施;
10.矿井事故应急救援预案。
第八条 各产煤县(市)区政府及其煤矿安全监督管理部门对重点矿井实施监督检查的过程中,发现有下列情形之一的,应当责令立即停止作业或者责令限期改正;拒不停止作业或者拒不改正或者逾期未改正的,责令停产整顿并处二万元以下的罚款:
1.瓦斯治理责任制不落实的;
2.安全投入不到位的;
3.没有设立瓦斯治理机构或者专业人员配备不足的;
4.有关防治瓦斯的管理制度、安全技术措施不落实的;
5.矿领导安全生产值班和跟班下井、监控系统中心站值班人员不到位的。
发现有下列情形之一的,应当责令停产整顿并处二万元以下的罚款:
1.瓦斯超限生产的;
2.应抽未抽或者先抽后采措施落实不到位的;
3.未按规定装备安全监控系统或者监控系统功能不齐全、运行不正常的;
4.通风系统不完善、通风设施质量不高、抗灾能力低的;
5.高瓦斯、突出矿井的采区没有专用回风巷的;
6.高瓦斯、突出矿井采区没有实行分区通风,存在串联风、循环风、风流短路的;
7.发生过瓦斯动力现象未经有资质的中介机构进行瓦斯等级鉴定,未按照突出矿井管理的;
8.突出矿井没有采取“四位一体”综合防突措施或者措施落实不到位的;
9.超通风能力生产的。
第九条 任何单位或个人不得危害煤矿矿区的电力、通讯、水源、交通及其他生产设施;禁止任何单位或个人扰乱煤矿矿区的生产秩序和工作秩序。违反规定的,依照相关法律法规予以处罚或追究相关法律责任。
第十条 煤矿企业每周必须组织一次安全大检查,由矿长或副矿长组织安全管理人员对矿井进行全面检查,按“三定”即定责任人、定措施、定时间整改隐患,做到“检查、整改、验收”三落实。违反规定的,责令限期整改,逾期未改正的,责令停产整顿。
第十一条 供电企业因故需要停止向煤矿供电的,必须提前24小时通知煤矿企业,无故停电导致煤矿发生安全事故的,按照有关法律法规追究供电单位和责任人的责任。
第十二条 在安全检查工作中,不严格按《煤矿安全规程》检查,导致发生煤矿安全事故的;各级煤矿安全监管部门工作人员对不符合安全生产条件矿井予以批准或验收的;对停产整改的矿井未暂扣相应证照的;对有关责任人给予降级或撤职的行政处分;构成犯罪的,依照刑法有关规定追究刑事责任。
第十三条 各级人民政府、煤矿安全监管部门,对煤矿安全事故隐瞒不报、谎报或者拖延不报的,对直接负责的主管人员和其他直接责任人员给予行政记过至降级处分;构成犯罪的,依照刑法有关规定追究刑事责任。
第十四条 煤矿企业的法定代表是煤矿安全生产第一责任人,全面负责本单位的安全生产管理,必须认真执行《安全生产法》的规定:
(一)持有合法有效的矿长资格证;
(二)建立、健全本单位安全生产责任制;
(三)组织制定本单位安全生产规章制度和操作规程;
(四)保证本单位安全生产投入的有效实施;
(五)督促、检查本单位的安全生产工作,及时消除隐患;
(六)组织制定并实施本单位的生产安全事故应急救援预案;
(七)及时、如实报告生产安全事故。
未认真执行以上规定之一的,责令限期整改,逾期未改正的,责令停产整顿。如因此导致发生安全事故,构成犯罪的,依照刑法有关规定追究煤矿法定代表人及其矿长的刑事责任;尚不构成犯罪的,依照有关规定吊销矿长资格,五年内不能取得矿长资格,对煤矿法定代表人处二万元以上二十万元以下罚款。
第十五条 煤矿企业必须设置安全管理机构并配备不少于3名持证的专门安全管理人员和一名安全副矿长、一名技术副矿长。违反规定的,责令限期整改,逾期未改正的,责令停产整顿,可以并处煤矿企业或主要负责人二万元以下罚款。
第十六条 煤矿企业必须安装和使用符合国家和行业安全标准,取得煤安标志的矿井机电设备、仪器仪表,不得安装和使用不符合上述标准的机电设备和仪器仪表以及假冒伪劣产品。违反规定的,责令限期整改;逾期未改正的,责令停止建设或停产整顿,可以并处五万元以下罚款;造成严重后果,构成犯罪的,依照刑法追究刑事责任。
第十七条 煤矿企业必须建立安全目标管理制度、安全奖惩制度、安全技术措施编制及审批制度、安全投入保障制度、应急救援制度、安全操作规程管理制度、质量标准化制度、安全隐患报告制度、安全检查制度、安全办公会议制度、设备设施检查维修制度、职工教育培训制度、矿灯管理制度、入井检身和出入井登记制度、重大危险源(6类)管理制度、民爆物品管理制度、测风制度、安全仪表及设备检验调校制度、爆破作业制度、交接班制度、伤亡人员统计报告制度、矿井和重要设施保卫制度、劳动保护用品配备与管理等制度,并认真组织职工学习和严格执行。每缺一项,责令限期整改,逾期未改正的,责令停产整顿。如因此导致发生安全事故,构成犯罪的,依照刑法有关规定追究煤矿法定代表人及其矿长的刑事责任;尚不构成犯罪的,依照有关规定吊销矿长资格,五年内不能取得矿长资格,并对煤矿处二万元以上二十万元以下罚款。
第十八条 煤矿企业必须对安全生产作业管理实行正副矿长轮流值班制,矿长外出3天以上必须向县(市)区煤矿安全监督管理部门主要领导请假,3天以内向煤管所(煤炭分局)长请假。
第十九条 煤矿企业特员持证率必须达100%,并按“三班制”配齐。违反规定的,责令限期整改,逾期未改正的,责令停产整顿并处二万元以下罚款。
第二十条 煤矿企业必须严格执行一名矿级领导带班,安全管理人员、特员足额跟班下井检查的作业安全管理。违反规定的,责令限期整改,逾期未改正的,责令停产整顿,违反规定的处以二千元以上五千元以下罚款。
第二十一条 煤矿企业正副矿长及其安全管理人员不得违章指挥,必须对违章作业进行制止,对重大隐患及时采取措施。违反规定的,给予警告,可以并处一万元以下的罚款。因此而发生重大伤亡事故的,依照刑法第一百一十四条的规定追究刑事责任。
第二十二条 煤矿企业必须足额提取安全费用及维简费,保证安全投入。违反规定的,责令限期整改,按规定提足必须的资金,逾期未改正的,责令停产整顿。如因此导致发生安全事故,构成犯罪的,依照刑法有关规定追究煤矿法定代表人及其矿长的刑事责任;尚不构成犯罪的,依照有关规定吊销矿长资格,并对煤矿处二万元以上二十万元以下罚款。
第二十三条 煤矿企业对新职工不得少于15天的安全培训,并指定有经验的老职工带领方能入井作业;煤矿职工每月不得少于3天的集中培训学习,学习的主要内容应为《煤矿安全规程》,作业规程、操作规程、安全生产方针政策、法律法规、规章制度,对“三违”人员进行批评教育。培训要有培训记录和职工签名,违反规定的,责令限期整改,逾期未改正的,责令停产整顿,并处二万元以下罚款。
第二十四条 煤矿企业必须与职工依法签订劳动合同,依法参加工伤社会保险并为职工缴纳保费;与矿山救护队签订救护协议,缴纳安全保证金。违反规定的,责令限期整改,逾期未改正的,责令停产整顿。
第二十五条 煤矿企业必须为从业人员配备符合国家或行业标准的劳动保护用品;按照国家有关规定进行安全评价;设备设施必须符合国家或行业标准,并按照国家有关规定进行检验;改建、扩建、新建项目必须严格执行安全设施“三同时”建设。违反规定的,责令限期整改,逾期未改正的,责令停产整顿或停止建设,可以并处五万元以下罚款,造成严重后果,构成犯罪的,依照刑法有关规定追究刑事责任。
第二十六条 煤矿企业不得随意变更法人代表、转让采矿权,确需变更法人、转让采矿权的,须按程序经煤炭、国土部门审批后依法进行。不能将煤矿矿井发包、出租给不具备安全生产条件的单位和个人,单项工程承包必须实行安全生产统一协调管理。违反规定的,责令限期整改,没收违法所得,违法所得五万元以上的,并处违法所得一倍以上五倍以下罚款;没收违法所得或者违法所得不足五万元的,单处或并处一万元以上五万元以下罚款;导致发生安全事故给他人造成损害的,与承包方、承租方承担连带赔偿责任。
第二十七条 煤矿企业不得超越批准的开采范围越层、越界开采;不得擅自开采保安煤柱;不得采用可能危及相邻煤矿生产安全的决水、爆破、贯通巷道等危险方法。违反规定的,依照《煤炭法》第七十条规定,责令停止作业,没收违法所得,并处违法所得一至五倍罚款,吊销其煤炭生产许可证;构成犯罪的,由司法机关依法追究刑事责任;造成损失的,依法承担赔偿责任。
第二十八条 煤矿企业作业场所空气中的有毒有害物质浓度,未按照下列规定检测的,责令改正,可以并处二万元以下的罚款:
(一)粉尘作业点,每月检测少于二次的;
(二)瓦斯、二氧化碳及其他有毒有害物质作业点,井下每班检测少于三次的。
第二十九条 煤矿企业井下采掘作业,未按照作业规程的规定管理顶帮;通过地质破碎带或者其他顶帮破碎地点时,未加强支护的,责令改正,可以并处二万元以下的罚款。
第三十条 煤矿企业井下采掘作业遇下列情形之一,未采取探水前进的,责令改正,可以并处二万元以下的罚款:
(一)接近承压含水层或者含水的断层、流砂层、砾石层、溶洞、陷落柱的;
(二)接近与地表水体相通的地质破碎带或者接近连通承压层的未封孔的;
(三)接近积水的老窑、旧巷或者灌过泥浆的采空区的;
(四)发现有出水征兆的;
(五)掘开隔离煤柱或者岩柱放水的。
第三十一条 煤矿企业开采煤炭必须符合煤矿开采规程、技术规范,遵守合理的开采顺序,达到规定的回采率。违反规定的,依照《煤炭法》六十九条规定,责令限期改正,逾期仍达不到规定的,建议发证机关吊销煤炭生产许可证。
第三十二条 煤矿企业必须按月测绘井上下工程对照图、采掘工程平面图和通风系统图,并定期向县级煤炭主管部门报送反映井下真实情况的图纸,接受监督检查。违反规定的,处以二万元以下罚款或者责令停产整改。
第三十三条 煤矿企业每年必须按规定进行瓦斯等级鉴定;煤矿井下出现瓦斯动力现象,必须在24小时内报告当地煤炭主管部门和煤矿安全监管机构,并及时申请具有国家规定资质的鉴定机构进行鉴定,不得隐瞒不报;必须每年核定矿井通风能力,保证以风定产,经核定的矿井通风能力应当报省级煤炭主管部门审核后,报省级煤矿安全监察机构备案。违反规定的,责令限期整改;逾期未改正的,责令停产整顿,可以并处二万元以下的罚款。
第三十四条 煤矿企业必须认真落实瓦斯治理的有关规定和措施,高瓦斯矿井和煤与瓦斯突出矿井的负责人应当每季度向当地煤矿安全监管机构和煤矿安全监察机构报告一次瓦斯治理情况;违反规定的,责令限期整改,逾期未改正的,责令停产整顿,可以并处二万元以下的罚款。
第三十五条 煤矿企业必须积极配合煤矿安全监管部门的安全检查和督察,不得拒绝、阻碍;必须执行安全指令;不得提供虚假情况;不得隐瞒事故隐患;发生安全事故不得隐瞒不报、慌报、拖延不报。违反规定的,给予警告,可以并处一万元以下的罚款。构成犯罪的,依照刑法有关规定追究有关人员的刑事责任。
第三十六条 煤矿企业发生安全事故的,必须严格按照云南省煤矿安全伤亡事故赔偿标准进行赔偿,拒不承担或者负责人逃匿的,由人民法院依法强制执行。
第三十七条 对于停产整改和停产整顿的矿井,由县级煤矿安全监管部门报请同级煤炭、国土、煤矿安全监察、工商管理部门暂扣相关证照,待整改或整顿验收合格后返还相关证照;擅自恢复生产的按非法矿井查处。
第三十八条 煤矿企业发生重伤事故或一至二人死亡事故的,处二至五万元罚款;发生三至九人死亡事故的,处五万至十万元罚款;发生十人以上死亡事故的,处十万至二十万元罚款。
第三十九条 对发生重大责任事故的矿井并符合下列条件的,由当地政府组织进行矿井公开拍卖:年产9万吨以下(含9万吨)的矿井年内发生两起重大事故或累计死亡人数超过6人的;年产9万吨以上(不含9万吨)矿井年内发生事故,累计死亡10人及其以上的;发生一次死亡10人及其以上特大事故的。矿井产量以《煤炭生产许可证》核定为准。
第四十条 本规定涉及执行中的具体问题由曲靖市煤矿安全监督管理局负责解释。
第四十一条 本规定自公布之日起施行

In this Ordinance, unless the context otherwise requires-

The Director shall in writing appoint one or more public

Without prejudice to subsection (2), the Director shall have and

PART III THE REGISTER
egister of ships
The Registrar shall keep a register of ships
registered or
isionally registered under this Ordinance.
The register shall contain such particulars in respect of
ships,
rs and their respective interests in ships, demise
charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being
oduced in legible form.

person may, on payment of the prescribed fee-
inspect the register in legible form;
require to be furnished with a copy of, or extract from, any entry
in
register in legible form; or
require such copy or extract to be certified as a true copy by

Where it appears to any person interested that there is a

r in the register, he may apply in writing to the
Director for

Upon receipt of an application under subsection (1) the Director
may,
n his opinion there is a material error in the register-
direct the Registrar to rectify the register; or
subject to subsection (3), require the applicant to apply to the
High
t for rectification of the register.
Subsection (2) (b) shall not apply in any case where, in the
opinion
he Director, the material error is due to the negligence or wilful

Notice of an application to the High Court under this
section for
ification shall be served by the applicant on the Director
and the
ctor may appear and be heard in the proceedings.
The High Court may, in proceedings under this section-
make such order as it thinks fit concerning the rectification of
the

decide any question that it is necessary or expedient to

A copy of an order under subsection (5) shall be served
on the

The Registrar shall-
comply with any direction to rectify the register under
subsection (2)
upon receipt of the copy of an order served under subsection (6),

he order so requires, rectify the register accordingly.
For the purposes of this section-
there is a material error in the register if there is an error
of fact
ubstance in the register;
without limiting the generality of paragraph (a), there is a
material
r in the register if-
an entry is omitted from the register;
an entry is made in the register without sufficient cause;
) an entry wrongly exists in the register; or
there is an error or defect in an entry in the register; and
the reference in paragraph (b) (i) to an entry omitted
from the
ster shall be read as including a reference to a matter
that is
ired or permitted by this Ordinance to be entered, or to remain,
in
register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be
exercised

Correction of clerical errors in register
Registrar may correct, or cause to be corrected, any clerical
error or

Subject to this Ordinance, a ship is registrable if-
a majority interest in the ship is owned by one or more
qualified
